Photography & Media Release
Effective Date: 1 October 2024
Spore & Lore Inc. ("we," "us," or "our") may capture photographs, video recordings, and other media during excursions, workshops, and related activities for promotional, educational, and archival purposes. This Photography & Media Release outlines participant rights, permissions, and restrictions regarding the use of such media.
By participating in a Spore & Lore Inc. activity, you acknowledge and agree to the terms below.
1. Consent to Photography & Media Use
Participants acknowledge that their image, likeness, or voice may be captured in photographs, video recordings, and audio recordings during Excursions, Workshops or other activities. By attending, participants grant Spore & Lore Inc. the irrevocable right and permission to
- Record, use, edit, reproduce, distribute and publish such media in any format, including but not limited to digital platforms, printed materials, advertisements, and social media
- Utilize media content for promotional, educational, documentary, and archival purposes without further consent or compensation
2. Ownership & Rights
All photographs, videos, and recordings captured by Spore & Lore Inc. remain the exclusive property of Spore & Lore Inc.. Participants waive any rights to:
- Inspect or approve the final media content before publication
- Receive compensation for the use of their image or likeness
- Prevent the use of media content in Spore & Lore Inc.’s authorized materials, provided its use aligns with the company’s mission and brand integrity
Spore & Lore Inc. will not sell or license participant media to third parties for unrelated commercial use.
3. Opting Out of Photography & Media Use
Participants who do not wish to be photographed or recorded must submit a written opt-out request at least twenty-four (24) hours before the scheduled activity by contacting Spore & Lore Inc. through the official Contact page.
While opting out does not exclude participation in excursions, participants should make reasonable efforts to avoid appearing in the frame of any media captured. Spore & Lore Inc. will make every effort to honour opt-out requests but cannot guarantee complete avoidance of incidental capture (e.g., appearing in the background of group photos).
4. Participant-Generated Content
Participants are welcome to take personal photographs during Excursions, but all media captured must comply with the following guidelines:
- Photographs and videos taken by participants must be for personal, non-commercial use only
- Any media intended for resale, promotional content, or broad distribution requires prior written consent from Spore & Lore Inc.
- The creation of video blogs, live streams, professional recordings, or other widely distributed content is strictly prohibited
- Participants must respect the privacy of others and obtain express permission before capturing media of fellow participants
5. Media Use Restrictions & Safeguards
Spore & Lore Inc. prioritizes participant privacy and ensures responsible media use by adhering to the following policies:
- Personally identifiable information (e.g., full names, contact details) will not be publicly shared without explicit written consent
- Media will only be used in contexts that align with Spore & Lore Inc.’s mission and brand integrity
- Requests for media removal will be considered on a case-by-case basis and must be submitted via the official Contact page
6. Governing Law and Dispute Resolution
This Photography & Media Release is governed exclusively by the laws of Ontario, Canada. Any disputes, controversies or claims arising from its shall first be resolved through mediation. If mediation is unsuccessful, disputes shall be submitted to binding arbitration within Ontario in accordance with the Arbitration Act, 1991, unless otherwise agreed upon by both parties in writing.
7. Changes to These Terms
Spore & Lore Inc. reserves the right to update this Photography & Media Release at any time. Changes will take effect upon posting to our website. Continued participation or use of our services constitutes acceptance of updated terms.
8. Enforcement
This Photography & Media Release applies to all participants at the time of their engagement with Spore & Lore Inc. Updates to its terms apply prospectively and will not retroactively affect prior engagements unless explicitly stated. If any provision is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
