These Terms & Conditions are binding as of 1 October 2025.

Spore & Lore Inc. (“we,” “us,” or “our”) provides guided foraging excursions and access to our website and online content. These Terms & Conditions govern your use of our services, website, and associated offerings. By purchasing tickets, participating in our excursions or using our website, you confirm that (i) you are legally able to agree to these terms, and (ii) you agree to comply with these Terms & Conditions.

1. Description of Services

Spore & Lore Inc. offers guided educational excursions focusing on foraging wild mushrooms, plants, and related topics. We reserve the right to modify these services at our discretion.

2. Tickets and Booking Policies

a. Ticket Purchases

• All prices are listed in Canadian dollars (CAD) and include applicable taxes unless stated otherwise. Payments are due in full upon booking unless specified.
• All tickets are non-refundable, including cases where participants are unable to attend for any reason.
• Tickets are sold on a first-come, first-served basis and are confirmed only upon receipt of payment.
• By completing a ticket purchase, participants acknowledge and agree to these Terms & Conditions.

b. Ticket Transfers

Tickets may be transferred to another participant provided the ticket type matches (e.g., children's tickets cannot be transferred to adults).

• Ticket transfers must be requested in writing at least 48 hours before the scheduled excursion.
• Spore & Lore Inc. reserves the right to deny transfer requests at its sole discretion.

c. Weather and Rescheduling

• Excursions are rain or shine; refunds will not be issued for inclement weather.
• Refunds due to extreme weather events (e.g., severe storms) will be made solely at our discretion.
• Spore & Lore Inc. reserves the right to modify the location, date, or time of any excursion. Affected ticket holders will be notified promptly, and no refunds will be issued unless the event is canceled.
• In the event Spore & Lore Inc. cancels an excursion, affected ticket holders may either receive a full refund or ticket for the same excursion type at future date, subject to availability.

d. Force Majeure

Spore & Lore Inc. is not liable for delays, cancellations, or changes to excursions caused by circumstances beyond our control, including but not limited to natural disasters, "acts of god", war, strikes, pandemics, government-imposed restrictions, or any other events rendering performance impossible or impractical.

e. No-Show Policy

Failure to attend an excursion without prior notification will result in the forfeiture of your ticket.

3. Participant Responsibilities

a. Preparation

• Adult ticket holders are responsible for wearing appropriate clothing, footwear, sun and insect protection, and ensuring that all children in their care do the same
• Adult ticket holders are responsible for obtaining and bringing all gear they and any children in their care will require for their safety, comfort and enjoyment of the excursion. Gear requirements and recommendations are provided in each Excursion's Page

b. Adult Supervision

• Adults holding tickets purchased in conjunction with children's tickets are fully responsible for the safety, transportation, behavior, and well-being of those children. This includes carrying children who are unable to keep up or become tired during the excursion.
• Adults must actively supervise and ensure the safety, appropriate behavior, and compliance of all children under their care throughout the excursion.

c. Zero-Tolerance Policy

Spore & Lore Inc. enforces a zero-tolerance policy for the following behaviors. Participants may be dismissed from excursions without refund if they, or children under their supervision, engage in any of the following:

1. Littering.
2. Vandalism, including carving or defacing natural features.
3. Intentional destruction of nature (e.g., felling trees, destroying nests).
4. Harassment or harm to animals.
5. Disruptive or disrespectful behavior (e.g., verbal or physical aggression).
6. Discriminatory behavior, including mockery or belittlement of belief systems.
7. Unauthorized content creation (e.g., filming video blogs).
8. Playing music or media aloud during excursions.
9. Solicitation of any kind.
10. Disregard for the guide’s instructions, including rules about collecting foraged items or posted trail signage.

Dismissals are at the sole discretion of the guide, whose decision is final, non-negotiable, and not subject to appeal. No refunds will be issued in such cases. Dismissals apply equally to adult and child participants, and no exceptions will be made in cases of policy violations. If an Adult Ticket Holder is dismissed, all children under their supervision shall also be dismissed. Similarly, if a child is dismissed, the supervising Adult Ticket Holder shall also be dismissed.

4. Assumption of Risk and Liability

Participation in excursions involves inherent risks, including exposure to environmental hazards, uneven terrain, and potential allergens. By attending, you acknowledge these risks and agree to participate at your own discretion.

a. Transportation and Parking

Participants are responsible for their own transportation to and from the event. Spore & Lore Inc. is not liable for:

• Delays caused by traffic or other travel disruptions.
• Damage to or theft of vehicles or belongings in parking areas.

b. Medical Considerations

Participants must proactively disclose any relevant medical conditions or allergies during or prior to ticket purchase. Failure to do so may result in dismissal from the excursion without refund if safety concerns arise. Participants are solely responsible for managing their health needs during excursions, including carrying and administering any necessary medications or interventions (e.g., epinephrine autoinjectors, inhalers). Spore & Lore Inc. is not responsible for providing medical assistance or carrying medical supplies. Spore & Lore Inc. assumes no liability for adverse outcomes related to undisclosed conditions. By attending, participants acknowledge and accept all medical risks associated with their participation and agree to manage their health needs independently.

c. Waiver of Liability

Spore & Lore Inc., its employees, and affiliates are not liable for injuries, illnesses, losses, or damages sustained during excursions or related activities. This includes but is not limited to:

• Physical injuries from terrain or wildlife encounters.
• Adverse reactions to ingested foraged items.
• Loss or damage to personal property.

Spore & Lore Inc. will not be liable for any damages arising from the use of our website or services. This includes direct, indirect, incidental, punitive, and consequential damages. Our website may contain links to third-party websites. Spore & Lore Inc. is not responsible for the content or practices of these websites and will not be liable for any damage arising from the use of third-party websites or their services. 

5. Use of Our Website

Your use of our website is subject to these Terms and all applicable laws. You agree not to:

• Upload harmful or malicious content.
• Access restricted areas of the website.
• Copy, distribute, or use website content without explicit permission.
• Use the website for illegal or disruptive purposes.

All website content is the intellectual property of Spore & Lore Inc. Unauthorized use is prohibited. You may not reproduce, modify, distribute, or create derivative works from any content on our website without prior written consent.

6. Photography and Media

By participating in excursions, you consent to being photographed or recorded for promotional purposes unless you notify us in writing prior to the event. 

• Photos and videos may be used on our website, social media, or marketing materials.
• Spore & Lore Inc. retains sole discretion over the use, editing, and publication of any photographs or recordings taken during excursions. Personal or identifying details will not be shared without explicit participant consent.
• Participants who do not wish to be photographed or recorded must notify us in writing at least 24 hours prior to the excursion.
• Participants who opt out of photography will not be excluded from general group photos used for promotional purposes where they are not individually identifiable.

7. Governing Law and Dispute Resolution

These Terms & Conditions are governed exclusively by the laws of Ontario, Canada. Any disputes arising under these Terms shall first be submitted to mediation or arbitration within Ontario, prior to litigation, unless otherwise agreed by both parties in writing.

8. Changes to These Terms

Spore & Lore Inc. reserves the right to update these Terms & Conditions at any time. Changes will take effect upon posting to our website. Continued participation or use of our services constitutes acceptance of updated terms.

9. Enforcement

These Terms & Conditions apply to all participants and website users at the time of their engagement with Spore & Lore Inc. Updates to these Terms & Conditions apply prospectively and will not retroactively affect prior engagements unless explicitly stated. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
